Terms of Service

The agreement between you and CC Upturn Ventures UG (haftungsbeschränkt).

These Terms govern your use of makethemcall.com and the Make Them Call service ("the Service"). By requesting a free preview, subscribing, or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. The Service

Make Them Call operates a 24/7 front desk for your business. The Service texts back missed callers, books jobs on your calendar, follows up after the job for customer reviews, and helps surface your business on Google. As part of the subscription we also build and host a modern website for your business on your own domain (or a *.makethemcall.com subdomain by default).

2. Free preview

When you submit the /start/ form, we send you a free preview of your front desk — including a rebuilt version of your current website at the preview URL. We typically email the preview link within 15 to 20 minutes. No payment is required to receive the preview.

To activate your front desk and keep your preview live, you complete checkout at $199/month. If you don't, your preview is deleted within 30 days.

3. Fees

• Monthly subscription: $199.00 USD per month, billed monthly from the day you complete checkout.

Prices include VAT where applicable. Payments are processed by Revolut Bank UAB.

4. Money-back guarantee

If you're not satisfied with your front desk within 30 days of your first payment, write to hello@makethemcall.com for a full refund of any charges already billed. Your front desk is then deactivated and your data deleted.

5. Cancellation

You can cancel your monthly subscription at any time by emailing hello@makethemcall.com. Cancellation takes effect at the end of the current billing period. After cancellation, your site stays online for 30 days then is permanently removed. Your phone number, custom domain DNS records, and Google Business Profile remain yours.

6. Your content

You own all text, images, branding, and other materials you provide to us ("Customer Content"). You grant Make Them Call a limited, non-exclusive licence to host, copy, modify, and display the Customer Content solely for the purpose of operating the Service.

You confirm you have the rights to all Customer Content you submit and that it doesn't infringe anyone else's rights. You're responsible for the legality of Customer Content.

7. Acceptable use

Don't use the Service to publish illegal content, infringe intellectual-property rights, send spam, distribute malware, or attempt to gain unauthorised access. We can suspend or terminate accounts that breach this section without refund.

8. Service availability

We aim for high availability but the Service is provided "as is" without uptime guarantees. We carry out maintenance windows and may pause access briefly when needed; we'll give reasonable advance notice for planned downtime.

9. Liability

To the maximum extent permitted by law, CC Upturn Ventures UG's total aggregate liability for any claim arising out of or in connection with these Terms is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect or consequential losses, lost profits, or lost data.

Nothing in this section limits liability for: (a) damages caused by intent or gross negligence, (b) personal injury, or (c) statutory product-liability claims, where excluding such liability is not permitted under German law.

10. Changes

We may update these Terms. Material changes will be emailed to active customers at least 30 days before they take effect. Continuing to use the Service after a change means you accept the new Terms.

11. Termination

Either party can terminate the agreement at any time. Make Them Call may terminate immediately if you breach these Terms. On termination, sections 6 (your content), 9 (liability), 12 (governing law), and any unpaid fees survive.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Exclusive place of jurisdiction for disputes arising from this agreement is Berlin, Germany, to the extent permitted by law.

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
